Marketing partners and publicly available databases (We receive information from our marketing partners, e.g., financial institutions, and other businesses and public databases which is used to help us serve you).
We use this information to evaluate your motorcycle financing applications, locate an appropriate lender, provide you with high quality service, prevent fraud and, with your consent, inform you of offers for other 123-Motorcycle Loans services offered by third parties. We may also use this information to confirm your identity when you call us to inquire about your accounts.
123-Motorcycle Loans may disclose information about you to the following types of third parties: Motorcycle financing affiliates; service companies (companies that provide services to 123-Motorcycle Loans in order to process your funding application); financial institutions, and credit bureaus, collection agencies. Your information is disclosed to the foregoing entities solely for the getting a loan that meets your criteria. Sharing Information with Service Companies -- In order to provide quality service, 123-Motorcycle Loans contracts with new and used car loan service providers for essential roles in processing your application. We may disclose some or all of the information we collect to these service providers but only in order to obtain credit for you. All of 123-Motorcycle Loans's service providers have entered into a contract with 123-Motorcycle Loans that forbids them from using information provided by 123-Motorcycle Loans for any purpose other than providing the service for 123-Motorcycle Loans customers. We take security precautions to monitor the use of the information and prevent the use of the information for any other purpose.
Information Sharing With Merchants -- We does not share any information with unrelated merchants for the purpose of extending offers of goods and services without your consent. Information Sharing with Partners -- We offers our products in conjunction with financial institutions and other businesses (collectively, 123-Motorcycle Loanss Partners). By completing a Motorcycle credit application with 123-Motorcycle Loans for the purpose of locating a loan that meets your criteria, you agree to the sharing of information with that partner. These relationships are clearly stated in the application and by completing the application you agree to the information sharing by 123-Motorcycle Loans and the partner which may include: your name, address, phone number, e-mail address, and personal financial information.
Credit Reports and Other Uses of Information -- In applying for good and bad credit Motorcycle loans, you agree that we may request consumer credit reports from one or more credit reporting agencies in connection with your application and the administration of such application. You also authorize us to exchange credit information concerning you or your use of the Account with (and answer questions and requests from) others, such as merchants, other lenders and credit reporting agencies.

We have no liability whatsoever to you or any third party for your use of or inability to use the site, services, materials, offers, programs, data and/or underlying products or services and we disclaim any and all warranties, expressed or implied, that your use of same will be uninterrupted, error-free, secure, reliable, or that any of the programs will be available to you.
The above repudiation of damages is a fundamental element of bargain between the parties, including you and Company. Agreement Not To Bring, Join Or Participate In Class Actions: To the extent permitted by law, you agree that you will not bring, join or participate in any class action as to any claim, dispute or controversy you may have against us, our employees, officers, directors, servicers and assigns. You agree to the entry of injunctive relief to stop such a lawsuit or to remove you as a participant in the suit. You agree to pay the attorney's fees and court costs we incur in seeking such relief. This agreement does not constitute a waiver of any of your rights and remedies to pursue a claim individually and not as a class action in binding arbitration as provided above. This agreement not to bring, join, or participate in class actions is an independent agreement and shall survive the closing and repayment of the loan for which you are applying. By submitting this Application, you certify that all of the information provided above is true, complete and correct and provided to us for the purpose of inducing us to make the loan for which you are applying. You also agree to the Agreement to Arbitrate All Disputes and the Agreement Not To Bring, Join Or Participate in Class Actions. You authorize us to verify all information that you have provided and acknowledge that this information may be used to verify certain past and/or current credit or payment history information from third party source(s). We may utilize Check Loan Verification or other similar consumer-reporting agency for these purposes. We may disclose all or some of the nonpublic personal information about you that we collect to financial service providers that perform services on our behalf, such as the servicer of your short term loan, and to financial institutions with which we have joint marketing arrangements. Such disclosures are made as necessary to effect, administer and enforce the loan you request or authorize and any loan you may request or authorize with other financial institutions with regard to the processing, funding, servicing, repayment and collection of your loan.
